Although the Tier 1 Entrepreneur Visa route has been replaced by the Innovator Visa and Start-up Visa, those already holding Tier 1 Entrepreneur Visas can still apply for an extension until 5 April 2023 and for settlement until 5 April 2025. Initially granted for 3 years and 4 months, the visa may be extended for an additional 2 years if the eligibility criteria are met.
At Global Law Attorneys, we guide entrepreneurs through every step of their extension application, ensuring compliance with Home Office requirements while safeguarding their business future in the UK.
To extend your stay, applicants must demonstrate continued commitment and compliance through one or more of the following:
Business Registration – Registered as a company director or self-employed within 6 months of receiving the visa.
Job Creation – Created at least two full-time jobs, each lasting a minimum of 12 months.
Business Involvement – Actively engaged as self-employed, a partner, or director for at least 3 months prior to application.
Investment – Invested either £200,000 or £50,000, depending on the original investment route, into one or more UK businesses.
Applicants must satisfy the Genuine Entrepreneur Test, which involves:
Proving ownership, management, or directorship of a genuine UK business.
Demonstrating genuine investment of the required funds.
Showing intent to continue operating the business in the UK.
Avoiding outside employment unrelated to their entrepreneurial activities.
Achieving 75 points under the official extension points criteria.
Review Compliance – Ensure you meet registration, investment, and job creation requirements.
Collect Documentation – Evidence of business activity, investment, and job creation must be prepared.
Submit Application – Apply before your current visa expires and pay the applicable fees.
Pass the Genuine Entrepreneur Test – Demonstrate your ongoing entrepreneurial commitment.
